Terms of Use

These terms govern your use of the VPN Defendr+ iOS application. They are written to be read, not to be skipped. Installing or using the app means you accept them.

1. Who this agreement is with

The app is published and licensed by SEAN OOD, a company registered in Bulgaria at Tsar Ivan Shishman str., Bl. No 33, entr. A, fl. 7, apt. 43, Dupnitsa 2600 ("we", "us"). "You" means the person using the app.

If you do not agree to these terms, do not install or use the app. If you have already installed it, delete it.

2. Licence we grant you

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on Apple devices that you own or control, for your own non-commercial use, in accordance with Apple's Usage Rules in the App Store Terms of Service.

You may not copy, modify, reverse-engineer, decompile, rent, lease, sell, sublicense or redistribute the app, or attempt to extract its source code, except to the extent that applicable law expressly permits it despite this restriction. The app and everything in it remain our property; nothing here transfers ownership to you.

3. Eligibility

You must have reached the age of digital majority where you live and be legally able to enter into this agreement. If you are using the app in a country where VPN services are restricted or require a licence, complying with that law is your responsibility.

4. Subscriptions and billing

The app is free to download. Full functionality is offered through an auto-renewing subscription. Available plans, prices and durations are displayed in the app before you confirm a purchase, in your local currency.

• Payment is charged to your Apple Account when you confirm the purchase.
• The subscription renews automatically for the same period at the same price unless auto-renew is turned off at least 24 hours before the current period ends.
• Your Apple Account is charged for the renewal within 24 hours before the end of the current period.
• Where a free trial is offered, any unused portion of it is forfeited when you purchase a subscription.
• Prices may change. We will not apply a new price to your renewal without notice and, where the law requires it, your consent.

Apple is the merchant of record for all purchases. We do not process payments and never receive your payment card details.

5. Cancelling

You can cancel at any time in Settings → your name → Subscriptions on your iPhone. Cancelling prevents the next charge; it does not shorten or refund the period you have already paid for. Deleting the app does not cancel a subscription. Step-by-step instructions are on our support page.

6. Refunds

Because Apple takes the payment, Apple handles refunds under its own policy. We cannot issue, reverse or guarantee a refund. Requests go to reportaproblem.apple.com.

If you are a consumer in the EU, your statutory withdrawal rights under applicable consumer law are unaffected by this section.

7. Acceptable use

You agree not to use the app to:

• break any law that applies to you, or help anyone else do so;
• send spam, malware or fraudulent traffic, or run denial-of-service or intrusion attempts;
• infringe anyone's intellectual property rights;
• gain unauthorised access to any system, network or account;
• distribute material that sexually exploits children, or content that is unlawful where it is received;
• overload, probe or interfere with our servers, or resell the connection to third parties.

We may suspend or end access where we have reasonable grounds to believe this section is being breached, or where a lawful order requires it.

8. What the service is, and is not

The app creates an encrypted tunnel between your device and a server you select. It protects the connection in transit. It does not:

• make you anonymous, or hide you from services you sign into;
• scan your device, inspect your files or assess the security state of your iPhone;
• remove trackers, cookies or scripts inside a website;
• guarantee access to any particular service, site or streaming catalogue.

Speeds and availability depend on your own network, distance to the server and load. We may add, move or retire server locations, and may perform maintenance that briefly interrupts the service.

9. Warranties

The app is provided "as is" and "as available". To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the app will be uninterrupted, error-free or secure against every threat.

Nothing in this section limits rights you have as a consumer under mandatory local law, including under Bulgarian and EU consumer protection rules.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for lost profits, revenue or data, arising from your use of or inability to use the app. Our total liability for any claim is limited to the amount you paid us for the app in the twelve months before the claim arose.

We do not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

11. Apple's position

• This agreement is between you and us only. Apple is not a party to it.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. Apple has no other warranty obligation.
• We, not Apple, are responsible for addressing any claim relating to the app, including product liability, legal or regulatory compliance, and consumer protection claims.
• We, not Apple, are responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.

12. Termination

You may end this agreement at any time by cancelling your subscription and deleting the app. We may suspend or terminate your licence if you breach these terms materially. Sections 9, 10, 11 and 13 survive termination.

13. Governing law and disputes

These terms are governed by the law of the Republic of Bulgaria, without regard to its conflict-of-law rules. If you are a consumer resident in the EU, this does not deprive you of the protection of mandatory consumer law in your country of residence, and you may bring proceedings in your local courts.

Before going to court, please write to us — most disputes are settled by email in a few days.

14. Contact

If we change these terms, the effective date at the top of the page changes with them. Continuing to use the app after that date means you accept the revised terms.
